FLASHBACK FRIDAY MOTSWALEDI LOSES AGAINST PRESIDENT KHAMA

BACK in September 2009, the High Court ruled against the now late Gomolemo Motswaledi, deciding President Ian Khama cannot be sued even as Botswana Democratic Party (BDP) President.
Court dismissed Motswaledi’s application in which he challenged his suspension as BDP Secretary General by Khama. The court cited immunity, noting that no legal action can be taken against the president. Motswaledi was to later be suspended by the party for making unilateral decisions and questioning Khama’s decisions to appoint subcommittee members, extend party executive secretary, Dr Batlang Serema’s contract, and rebuking party law firm, Collins and Newman, for publishing information about the party’s internal matters without the central committee’s consent.
He was to later form his own party, the Botswana Movement for Democracy (BMD), before he famously met his demise in a fatal car accident.
