Suspended sentence, intermittent custody

Taylor William Reid, 24, of Forest Hill, has been handed a suspended sentence with probation for committing an assault and for unlawfully being inside a house with intent to commit an indictable offence; and has been sentenced to intermittent custody for operating a motor vehicle while his blood alcohol level exceeded the legal limit.

Reid changed his pleas to guilty on Oct. 30, 2017, and the matters were adjourned to Jan. 2 to allow time for a pre-sentence report to be prepared and for sentencing.

Reid was handed a suspended sentence with one year of probation on the assault charge and the charge of unlawfully being inside a house. He was sentenced to 30 days of intermittent custody on the charge of impaired operation of a vehicle, to be served from 9 p.m. on Fridays to 6 a.m. on Mondays, beginning Jan. 5.

Reid will be on probation while not in custody. The court imposed a one-year driving prohibition against Reid.

Reid committed the offences in Hantsport on July 25, 2016. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Reid gave breathalyser readings of 200 and 180.

Distributed intimate image

Tony Morris Davidson, 49, of North Kentville, has been handed a conditional sentence with house arrest for knowingly distributing an intimate image of a person without consent and for failing to comply with his undertaking; and has been fined for driving while disqualified.

Davidson changed his pleas to guilty on Dec. 19 and the matters were adjourned to Jan. 4 for sentencing. Judge Alan Tufts handed Davidson an eight-month conditional sentence order with house arrest for the first three months, followed by daily curfew from 10 p.m. to 6 a.m. for the remaining time, on the charge of distributing an intimate image without consent and the undertaking charge. Davidson was fined $1,000 for driving while disqualified.

Davidson committed the offences in North Kentville on March 6, 2017, and in New Minas on April 7 and Nov. 5, 2017. A charge of failing to comply with his recognizance was withdrawn on Jan. 4.

Possessed stolen ATV

Troy Ronald Mcgill, 46, of Kingston, has been fined and sentenced to probation for possessing a stolen ATV of a value not exceeding $5,000.

Mcgill pleaded guilty to the charge on Jan. 2. Judge Alan Tufts fined Mcgill a total of $325 and sentenced him to six months of reporting probation.

Mcgill committed the offence in Kingston on Oct. 19, 2017.

Breathalyser offence

Luke Shane Taylor, 29, of Waterville, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit.

Taylor pleaded guilty to the charge on Jan. 2. Judge Alan Tufts fined Taylor a total of $1,625 and imposed a one-year driving prohibition against him.

Taylor committed the offence in Aldershot on Nov. 11, 2017. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Taylor gave breathalyser readings of 200 and 200.

Refused breathalyser, unlawfully in house

Jordan Lee Ward, 20, of Canning, has been fined for refusing to comply with a demand made to him by a police officer to accompany the officer for the purpose of enabling a sample of Ward’s breath to be taken for analysis by means of an approved screening device; and has been handed a suspended sentence with probation for unlawfully being inside a house.

Ward pleaded guilty to the charges in November and the matters were adjourned to Jan. 3 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Alan Tufts fined Ward a total of $1,300 on the refusal charge and imposed a one-year driving prohibition against him. Ward will be eligible for the ignition interlock program after three months.

Ward was handed a suspended sentence with 12 months of probation and was fined $100 in victim surcharges for unlawfully being inside a house.

Ward committed the offences in Centreville on Aug. 11, 2017. Charges of resisting two RCMP officers engaged in the execution of their duties arresting Ward by providing a false name, fighting and trying to escape custody; sexual assault and mischief were withdrawn on Jan. 3. A charge of unlawfully possessing hydromorphone was earlier withdrawn.

Refused breathalyser, failed to attend court

Jordan Allen Taylor, 22, of Deep Brook, has been fined for failing or refusing to comply with a demand made to him by a police officer to provide a sample of his breath to enable a proper analysis to be made by an approved screening device; and failing to attend court in accordance with a promise to appear.

Taylor pleaded not guilty to the charges in May and the matters were adjourned to Jan. 3 for trial. The accused was not present on Jan. 3 but the Crown was prepared for the trial to proceed. A warrant was issued for Taylor.

Taylor later appeared in court, in custody, and the warrant was vacated. He changed his pleas to guilty on the two charges. Judge Alan Tufts fined Taylor a total of $1,300 on the refusal charge and imposed a one-year driving prohibition against him. Taylor will be eligible for the ignition interlock program after three months. Taylor was fined a total of $130 for failing to attend court.

Taylor committed the offences in Kingston on May 7, 2016, and in Kentville on July 11, 2016.

Conditional sentence, time deemed served

Nathan Shane Atwell, 36, of Mount Denson, has been handed a conditional sentence with daily curfew and sentenced to time in custody deemed served after pleading guilty to several counts of failing to comply with his undertaking.

Atwell was present in Kentville provincial court on Jan. 4, when he pleaded guilty or changed his pleas to guilty to seven counts of failing to comply with his undertaking. Judge Alan Tufts handed Atwell a four-month conditional sentence order with daily curfew from 10 p.m. to 5:30 a.m. for the entire time on three of the charges. Atwell was sentenced to one day in custody deemed served on each of the other four counts.

Atwell committed the offences in Avonport between May 5 and 6, 2017, in Black River between Nov. 4 and 5 and on Nov. 14, 2017, in Hantsport and Windsor on Nov. 16, 2017, and in New Minas on Dec. 24, 2017.

Six counts of failing to comply with a peace bond recognizance and two more counts of failing to comply with his undertaking were withdrawn or dismissed on Jan. 4. The court ordered a stay of proceedings with regard to another count of failing to comply with his undertaking.

Stole rum from NSLC

Dale Steven Mactavish, 28, of Kentville, has been handed a suspended sentence with probation for stealing a pint bottle of Captain Morgan rum from the Nova Scotia Liquor Corporation.

Mactavish changed his plea to guilty on Jan. 4. Judge Alan Tufts handed Mactavish a suspended sentence with three months of non-reporting probation. He has been ordered to pay $15.75 in restitution to the Kentville Nova Scotia Liquor Corporation store.

Mactavish committed the offence in Kentville on Feb. 18, 2017. Three counts of failing to comply with his undertaking were withdrawn or dismissed on Jan. 4.

Suspended sentence for dangerous driving

Adrian Michael Smith, 28, of Arlington, has been handed a suspended sentence with probation for operating a motor vehicle on a highway in a manner that was dangerous to the public.

Smith changed his plea to guilty on Oct. 30 and the matter was adjourned to Jan. 4 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Alan Tufts handed Smith a suspended sentence with 12 months of probation and fined him $200 in victim surcharges.

Smith committed the offence in Canning on Nov. 1, 2016. Two counts of threatening to use a weapon, a motor vehicle, in committing an assault were dismissed on Jan. 4.
