Crown wants court to revoke accused’s bail

The Crown will seek to have bail revoked for a city man charged in the dismemberment of a Calgary woman after he allegedly breached his release conditions.

Prosecutor Ken McCaffrey said Thursday he will ask a judge to deny bail for Joshua Jordan Weise on an allegation he violated his release by possessing a weapon.

And McCaffrey also said he will be seeking to have Weise’s earlier bail order revoked in light of his latest alleged transgression. Weise, 40, was rearrested on July 27, and charged with breaching a condition of his bail that he not possess or carry any weapon.

He appeared briefly in provincial court on the charge and defence counsel Michael Miller asked that his case be put over to Aug. 16.

Miller told Judge Lloyd Robertson he and lead counsel Rebecca Snukal are awaiting more disclosure from the Crown before proceeding with another bail bid.

“I believe we’re missing some critical information regarding the breach allegation,” he said.

Outside court, McCaffrey said he will be adding a second breach charge to the allegations Weise is facing when the case returns.

“We are opposed to any interim release (pending trial) and we’re applying to revoke his previous release,” McCaffrey said.

On July 7, the prosecutor consented to bail for Weise, despite objections from the family and supporters of Joey English, parts of whose body were found in a Crescent Heights park in June.

McCaffrey told court he could see no lawful reason to detain Weise. But at the time McCaffrey warned Weise he wouldn’t be so benevolent the next time around.

“I do want Mr. Weise to know that this is the one and only time the Crown will be consenting to his release,” he said.

Along with the breach charge, Weise faces an allegation of committing an indignity to a dead body.
