Restraining order against chef dropped
A civil charge in the form of a restraining order against prominent Calgary restaurateur Michael Noble has been dropped, according to his lawyer, Balfour Der.
A woman — who worked for Noble — alleged that Noble cornered her in a bathroom stall at a staff party on Jan. 30. She went on to file a restraining order after approaching police about the incident.
Documents obtained by Postmedia show that the complainant filed the restraining order as she didn’t feel comfortable seeing him.
She wrote that she volunteers at an organization at which Noble is a donor, and that he is known to come to the location.
“Prior to the criminal charges being laid, the complainant had begun a civil action at the Court of the Queen’s Bench seeking a restraining order against Mr. Noble,” said Der.
“As part of the process, we sought to cross-examine her on the affidavit that she had sworn to support her restraining order. The time for questioning came and was delayed at her behest.”
The cross-examination was set for May 14, but Der said she filed a discontinuance to end the matter.
No reason was given as to why the discontinuance was filed.
Noble is still facing one count of sexual assault and is set to appear in court May 30.
