No-contact order for accused in triple homicide

Victims’ families off-limits: judge

A Calgary man accused in the deaths of his parents and girlfriend has been ordered not to contact family members of the victims while he is in custody.

Dustin Duthie made a brief court appearance Wednesday via CCTV from the Calgary Remand Centre. At the request of duty counsel, Judge Lloyd Robertson adjourned the matter until next month as Duthie has not yet been appointed a lawyer through Legal Aid.

Duthie, 25, is facing three charges of second-degree murder in the deaths of his mother, Shawn Boshuck, stepfather, Alan Pennylegio­n, and his girlfriend, Taylor Toller.

Crown prosecutor Shane Parker asked Robertson for an order to prohibit Duthie from contacting five people, including family members of the victims.

Robertson issued the order and put the matter over until Sept. 12, when Duthie will appear via CCTV.

Court heard earlier this month that a psychiatri­st found Duthie mentally fit to stand trial.

Police found the body of Toller, 24, in a residence in the 2000 block of Applevilla­ge Court S.E. on July 31. The same day, officers also found the bodies of Pennylegio­n, 51, and Boshuck, 52, at a home in the 10100 block of Hidden Valley Drive N.W.

Police believe Toller was killed July 26, while Pennylegio­n and Boshuck are thought to have been killed July 31.
