Breaching four conditions of his bail, including attending a dinner function with children present, has landed former Homeless Foundation board member Robin Wortman a 90-day jail term.

But because Wortman has spent the last eight months behind bars, he won’t have to serve any additional time for his crimes, provincial court Judge Mark Tyndale said Monday.

Tyndale said Wortman’s crimes deserved up to four months behind bars, but because the Crown only sought three he would hand him that punishment.

Wortman earlier was convicted by Tyndale of four breaches of his release conditions he was on awaiting trial next February on charges including sexual assault and distributing child pornography.

The judge noted Wortman was unhappy with his release conditions, but took no steps to apply to have them relaxed.

“Mr. Wortman simply chose to ignore them,” Tyndale said.

He was in possession of a phone capable of accessing the internet and used the Drop-In Centre’s computer lab on several occasions where he had internet access.

Defence lawyer Jim Lutz said he anticipates seeking Wortman’s re-release prior to his trial next February.
