Sexual assault of city teenager captured on video, Crown says

The sexual assault of a Calgary teenager by three males was video recorded by them on their cellphones, a prosecutor said Monday.

In detailing the case she expects to call against two alleged sex offenders, Crown lawyer Pam McCluskey said the videos will be key to her case.

“Twenty-five minutes caught on video is the focus,” McCluskey told Court of Queen’s Bench Justice Scott Brooker, at the opening of the trial of Adham El-Sakaan and Timothy Fanning.

The two men, both 21, are charged with sexual assault and sexual assault with a weapon in connection with a Dec. 2, 2015, incident in the home of a then-young offender.

The third suspect, 17 at the time, earlier pleaded guilty and was sentenced in youth court.

McCluskey said the three males knew the 17-year-old complainan­t and took her to the youth’s home after Fanning picked up some booze at a liquor store.

“All three males engaged in sexual activity with (her),” the prosecutor said.

“She did not, in her mind, want any of it.”

A key piece of evidence will be videos found on their phones, McCluskey said.

“The males recorded parts of the sexual acts on their phones,” she said. “The court will see these videos.”

During the incidents, an electric toothbrush was used, the prosecutor said. The complainan­t was also punched in her private area during the sexual encounters, court was told.

In sentencing the youth last year to 12 months in custody followed by a year’s probation, youth court Judge Richard O’Gorman said, “The videos represent disgusting and despicable images.”

The trial before Brooker continues on Tuesday.
