Dangerous offender could face life in prison

Crown will be seeking indetermin­ate sentence for man who breached order

Dangerous offender Douglas Gordon Jenik stuck his nose into the crotch of a woman on a downtown elevator, an action that could end in his being locked up for good.

Jenik pleaded guilty Thursday to charges of sexual assault and breaching his long-term supervisio­n order for an attack last July 30 inside a downtown apartment complex.

And Crown prosecutor Janice Walsh told provincial court Judge Margaret Keelaghan she will be seeking an indetermin­ate sentence for the repeat sex offender.

If the Crown is successful, that would mean Jenik would be incarcerat­ed indefinite­ly, with periodic reviews to determine if he no longer poses a serious risk to the public.

“The Crown's applicatio­n ... will be for a dangerous offender indetermin­ate sentence,” Walsh said.

Walsh read in a statement of agreed facts, signed by Jenik and his lawyer, Telmo Dos Santos, detailing his latest crime.

The prosecutor said Jenik, who was deemed a dangerous offender in May 2015 when he was handed the equivalent of a 1,582-day sentence, was subject to a 10-year long-term supervisio­n order at the time of his latest sex crime.

Around 8:50 p.m. last July 30, a woman was entering her downtown highrise carrying a bag and two Starbucks drinks when Jenik approached and held open the exterior door.

After the woman used her fob to unlock the interior door, Jenik held it open as well before following her into the building and onto an elevator, Walsh said.

As the elevator ascended, Jenik began to stare at his victim before moving closer to her.

“The accused, arms clasped behind his back, began bending over at the waist leaning toward the complainan­t,” the prosecutor said.

The woman, trying to rationaliz­e his behaviour, thought perhaps Jenik was trying to read the writing on the bag she was carrying.

“Before the complainan­t could react, the accused, arms still clasped behind his back, touched the front part of her vagina, over her jean shorts, with his nose for approximat­ely two seconds.”

The woman then pushed Jenik away and, as she did this, the elevator door opened on the 16th floor and the offender got off, Walsh said.

A still photograph was taken from video footage from the building 's lobby and distribute­d among members of the Calgary Police Service, some of whom were able to identify Jenik.

Jenik, who has a lengthy criminal record for sexual assaults and exposing himself, will undergo a psychiatri­c assessment to determine if he continues to meet the criteria for a dangerous offender designatio­n.

The case returns to court in June.
