Sen­tenc­ing de­layed for sex crim­i­nal

cal­gar­ian Michael Wozny was on pa­role for man­slaugh­ter when he con­vinced a 14-yearold carstairs girl to per­form a sex act on him, court heard Fri­day.

read­ing from a state­ment of agreed facts, crown pros­e­cu­tor deanna dal­seide Haase said the con­victed killer had gone to the cen­tral al­berta town in au­gust 2014 to sell cig­a­rettes and mar­i­juana.

there he met his teenage vic­tim, the pros­e­cu­tor said.

“the ac­cused in­sisted the com­plainant per­form oral sex on him,” dal­seide Haase told court of Queen’s bench Jus­tice david Gates.

“the com­plainant was afraid to say no and com­plied.”

Over the course of the next few days, he sex­u­ally mo­lested her on two other oc­ca­sions, in­clud­ing an in­ci­dent in which he video­taped the abuse on his cell phone, dal­seide Haase said.

both she and de­fence coun­sel Katherin beyak agreed a sen­tence of two years, mi­nus credit for re­mand time, was ad­e­quate for Wozny, now 33, who pleaded guilty to sex­ual in­ter­fer­ence.

but Gates said he needed more in­for­ma­tion be­fore de­ter­min­ing whether he could ac­cept the joint rec­om­men­da­tion from the lawyers.

He ad­journed the case to Novem­ber, to set a date to con­tinue the sen­tenc­ing hear­ing.

at the time of the as­saults, Wozny was on pa­role from a nearly five-year sen­tence he was serv­ing for man­slaugh­ter in the killing of a cal­gary man Kevin bowser.

Wozny re­mains in cus­tody pend­ing a res­o­lu­tion to his case.
