Black Forehead has sentencing hearing set

A 32-year-old man who pleaded guilty last month to sexually assaulting two teenage boys won’t be sentenced until next year.

Cody Black Forehead is scheduled to have a sentencing hearing Jan. 25 in Lethbridge Court of Queen’s Bench on two counts of sexual interferen­ce.

Black Forehead pleaded guilty to the charges July 30, but the matter was adjourned to allow time for the preparatio­n of a psychologi­cal assessment to determine whether he is a risk to re-offend. The judge also ordered a pre-sentence report, which will include Black Forehead’s personal history and circumstan­ces to help the judge render a fit sentence. A Gladue Report, which is used to help sentence aboriginal offenders, will also be prepared.

The case was back in court Monday, where the sentencing date was set for the new year.

Black Forehead, who had previously elected to be tried by a Court of Queen’s Bench judge, was charged in May 2017 with two counts of sexual assault, two counts of sexual interferen­ce and one count of invitation to sexual touching. The charge of invitation to sexual touching was withdrawn following a preliminar­y hearing in January.

Black Forehead consented to be tried on the remaining four charges against him, but the two charges of sexual assault were withdrawn after he pleaded guilty to the charges of sexual interferen­ce.

Crown prosecutor Dawn Janecke told court in July that Black Forehead met the two boys downtown where he had an apartment. He bought alcohol for the three of them and they went back to his apartment where the boys became drunk and high. During the night Black Forehead sexually assaulted the boys.

Janecke said neither of the boys wanted to have sexual contact with the accused, and they told him they were only in Grade 9.

The maximum sentence allowed under the Criminal Code for sexual interferen­ce is 10 years.
