A 44-year-old man who was killed earlier this month following an altercation with another man, was facing numerous charges before they were withdrawn this week in Lethbridge provincial court.

Charges against Amber Bahadur Khadka of sexual assault, uttering threats to cause death or bodily harm, mischief, failing to attend for fingerprinting, and trespassing, were withdrawn Monday after court was told the accused had died. The sexual assault charges stem from an incident on April 25, after a woman reported an unknown man sexually assaulted her while she was outside having a cigarette shortly after 9 p.m. in the

600 block of 8 Street South. The incident was recorded on a security camera. Police said another woman had also been sexually assaulted, after she was approached in the 700 block of 5 Avenue South earlier in the evening.

That incident was also captured by video surveillance. Khadka turned himself in to police April 28, but he died May 5 after he was attacked and had to be taken to Chinook Regional Hospital, then Calgary after his condition grew worse. Police said Khadka was approached by a man at the intersection of 8 Street and 2A Avenue North just before 8:30 p.m. The two men became embroiled in an argument before Khadka was knocked down and hit his head on the ground. Lethbridge resident Sheldon Nicolas LePage is charged with manslaughter and one count each of failing to comply with a release order and failing to comply with a probation order. He is scheduled to appear in court on Monday.
