Dollard man aims to sue Canada Post over mailbox
John Benizri is taking legal action against his “neighbour from hell” — in this case a community mailbox that goes by the name of Canada Post.
Benizri has filed a motion seeking authorization to launch a class-actionsuitagainsttheCrowncorporation four months after a community mailbox was installed at the side of his corner property on Dauphin and Forsythe Sts. in Dollard-des-Ormeaux.
Citing a loss of property value, loss of enjoyment to property and loss of privacy in the class-action motion, Benizri is seeking unspecified damages from Canada Post, which is phasing out home delivery of mail to millions of Canadians.
When Benizri purchased the Dauphin St. home in 2001, a major consideration was to provide his family with a “high level of safety and peace,” according to the motion filed in Quebec Superior Court.
Since a 48-slot mailbox was installed in May, the motion noted that Benizri has had to close his windows at times because of the excessive noise caused by people collecting their mail with their car radios blasting. The community mailboxes are accessible 24 hours a day.
Benizri has a backyard pool and the motion says it is not uncommon for him to “catch people looking at him and his family in their backyard during family gatherings for uncomfortably prolonged periods.”
Canada Post, through a spokesperson, had no comment on the matter “as the case is now before the courts.”
