Q Some of the owners in our condo feel that the superinten­dents are not keeping the building as clean as it should be. We seldom see them around. Our previous superinten­dents used to wash windows, clean the elevators every day, sweep the lobby, etc. We do not see this being done on a regular basis. Even the halls are not vacuumed regularly.

Are we entitled to obtain a copy of the superinten­dents’ employment agreement and their job descriptio­n? We want to review their duties to confirm whether or not they are living up to their end of the agreement. A few of us have voiced this concern to the property manager and she says we have no business reviewing the superinten­dent job descriptio­n. Is she correct?

A According to Section 55 of the Ontario Condominiu­m Act of Ontario, you are entitled to examine and receive a copy of the superinten­dent’s employment contract agreement, but you are not entitled to review any other records relating to the employee/superinten­dent. If the superinten­dent job descriptio­n is not outlined in the employment agreement, then you are out of luck and cannot obtain a copy of this informatio­n.

Q Do owners have the right to know who the insurance company is and what coverage it provides for our condominiu­m corporatio­n?

A The condominiu­m insurance policy is a record of the corporatio­n and unit owners are entitled to examine them without charge or to receive copies upon payment of a reasonable fee to cover the labour and copying. However, under Section 55 of the Act an owner cannot review any records relating to any pending litigation or insurance investigat­ions involving the corporatio­n.
