Timeline for the $428M Engineering and Technical Support contract at the heart of the litigation
❚ June 16, 1999: TPG Technology wins contract to run Public Works’ computer networks.
❚ May 31, 2006: Public Works issues request for proposals to renew contract.
❚ Sept. 5, 2006: TPG, IBM and Montreal-based CGI Group respond with bids.
❚ October, early November:
Technical and financial evaluations.
❚ November to late January, 2007: Public Works conducts review of the evaluations.
❚ Early March: TPG learns it has lost to CGI.
❚ Mar. 23, 2007: TPG launches first of four complaints with Canadian International Trade Tribunal, citing perceived irregularities.
❚ Oct. 31, 2007: Public Works awards ETS contract to CGI.
❚ Dec. 20, 2007: Trade Tribunal rules TPG’s fourth complaint not valid.
❚ March 2008: TPG files $250M lawsuit against Public Works for economic injury.
❚ June 10, 2008: TPG president Don Powell testifies before a House of Commons committee about perceived irregularities in the ETS contract.
❚ June 30, 2008: Powell receives letter warning that bid-rigging charges are imminent in connection with certain non-ETS contracts.
❚ March, 2010: Justice files to dismiss TPG’s $250M lawsuit without a trial.
❚ Sept., 2011: Justice David Near, a former adviser to Conservative Justice Minister Rob Nicholson, dismisses TPG’s lawsuit after concluding there was “no genuine issue for trial.”. TPG appeals the ruling.
❚ Oct., 2011: TPG lodges complaint to Canadian Judicial Council, alleging Near was in a conflict of interest.
❚ April, 2012: The Council ruled there was “no evidence whatsoever of any improper motive” on the part of Judge Near.
❚ July 15, 2013: Federal Court of Appeal grants TPG’s appeal of Judge Near’s decision to dismiss its $250M lawsuit against Public Works, ruling that Judge Near “misapplied the summary judgment rule”.
