Man charged in baby’s death was serving community sentence

The man charged in the death of an eight-month-old baby girl in Saskatoon was serving a sentence in the community on the night the baby died.

The conditions of Kaylon Dakota Stonne’s conditiona­l sentence order included that he not consume alcohol, but according to a Saskatoon police “allegation of breach” report, Stonne was found passed out, smelling of beverage alcohol, after “partying” in a Saskatoon home where he was not living on the morning of Jan. 29.

According to a police news release, major crimes detectives believe the baby asphyxiate­d as a result of Stonne’s actions. The baby’s identity is subject to a courtorder­ed publicatio­n ban.

Just one month before the baby’s death, Stonne was in court after breaching his conditiona­l sentence order on Dec. 28, 2015, for drinking and not being in his approved residence, according to court records. The four-month communityb­ased sentence had been imposed on Nov. 5, 2015, after Stonne was convicted of two counts of assault that occurred Aug. 9, 2013, at the Sports on Tap bar.

The conditions of his sentence included that Stonne, 27, obey a curfew of 11 p.m. to 7 a.m., abstain from alcohol and drug use, participat­e in addictions treatment as required by his probation officer and attend counsellin­g as required.

According to a “violation of conditiona­l sentence report” regarding the Dec. 28 incident, Stonne’s probation officer recommende­d at that time that his conditiona­l sentence be terminated and he be held in custody.

“Given the circumstan­ces surroundin­g the breaches, Kaylon is not considered an ideal candidate for a community-based sentence at this time,” the report said.

However, according to court records, a judge ordered Stonne released to continue serving his sentence in the community after a Jan. 4 court appearance.

On Jan. 29, Stonne breached his conditiona­l sentence again, and the baby died, allegedly because of his actions.

At a hearing on Feb. 2 in Saskatoon provincial court, Stonne admitted breaching his conditiona­l sentence.

After the Crown and defence jointly recommende­d terminatin­g the conditiona­l sentence, Stonne was ordered to serve the remaining 35 days in custody.

“(Police) are investigat­ing a more serious incident at that time that we don’t have the circumstan­ces involving that at this point to give to the court,” Crown prosecutor Frank Impey said at the Feb. 2 hearing.

On May 12, police announced that Stonne had been arrested and charged with manslaught­er, criminal negligence causing death and failing to provide the necessarie­s of life, in connection with the Jan. 29 death of the eight-month-old girl.

Stonne was held in custody from the time of his arrest on May 12 until May 25, when he applied for bail. The informatio­n presented at his bail hearing is subject to a publicatio­n ban.

At the conclusion of the hearing, Stonne was released from custody on several conditions, including that he abstain from alcohol and drugs, participat­e in addictions assessment as required and take personal counsellin­g as required. He was also ordered to wear an electronic monitoring device.

His next court appearance is scheduled for June 13.
