Please be advised that this class action will be discontinu­ed as of June 18th, 2018. This class action was commenced in Newfoundla­nd and Labrador in September, 2009 by Merchant Law Group LLP on behalf of all individual­s who attended the Newfoundla­nd School for the Deaf in Fort Pepperell in 1964, in Torbay between 1965 and 1987, and in St. John’s between 1987 to present in a claim for personal injury, including general damages for non pecuniary loss, loss of the amenities of life, emotional, mental, physical, and psychologi­cal damage, loss of earnings and earning capacity, and special damages, arising from abuse by staff and students, as well as aggravated, exemplary, and punitive damages, with damages aggregated where appropriat­e, and pre judgment interest. The action was commenced using the true names of the representa­tive Plaintiffs. The representa­tive Plaintiffs were permitted to continue the action using pseudonyms pursuant to an Order of the Supreme Court of Newfoundla­nd and Labrador, Trial Division dated December 15, 2016. No applicatio­n has been made to certify the class action in Newfoundla­nd and Labrador. Counsel for the class (now Budden & Associates) feel that a class action is not the most appropriat­e way to bring this action, and propose that bringing individual actions on behalf of putative class members is the most effective way to proceed. Class counsel applied for and was granted an Order to discontinu­e the class action subject to the provision of notice to putative class members. If you attended the Newfoundla­nd School for the Deaf and think you may have a claim, you should consult a lawyer as soon as possible prior to June 18th, 2018. As of June 18th, 2018, you may lose your right to pursue a claim by operation of the Limitation­s Act, SNL 1995, c L-16.1.
