De­fence sug­gests al­leged vic­tim kissed taxi driver, took off her own pants

A de­fence lawyer rep­re­sent­ing a Hal­i­fax cab driver ac­cused of sex­ual as­sault sug­gested in court the woman kissed the driver be­fore tak­ing off her own pants.

De­fence lawyer Ian Hutchi­son made the sug­ges­tion Thurs­day as he was cross-ex­am­in­ing the woman, who tes­ti­fied Wed­nes­day she had no mem­ory of leav­ing Boomer’s bar down­town or get­ting into a cab on May 22, 2015. She told Hal­i­fax provin­cial court she had been drink­ing a lot and was quite in­tox­i­cated, and her next clear mem­ory was at the hos­pi­tal in the care of two nurses.

Hutchi­son’s cross-ex­am­i­na­tion came on the fourth day of a re­trial of Bas­sam Al­rawi be­fore Judge Ann Marie Sim­mons.

Const. Mo­nia Thibault tes­ti­fied ear­lier this week she found the pas­sen­ger un­con­scious and naked from the chest down in the back seat of the cab, while Al-rawi was in the front, push­ing the woman’s in­side-out jeans be­side the driver’s seat.
