Evaded po­lice, failed to at­tend court

Jor­dan Rus­sell At­twell, 21, of Cam­bridge, has been handed a con­di­tional dis­charge with pro­ba­tion for fail­ing to stop his ve­hi­cle as soon as was rea­son­able in the cir­cum­stances in or­der to evade po­lice; and fail­ing to at­tend court as re­quired.

At­twell pleaded guilty to the charges on Sept. 11 and the mat­ters were ad­journed to Nov. 13 to al­low time for a pre-sen­tence re­port to be pre­pared and for sen­tenc­ing. Judge Christo­pher Man­ning handed At­twell a con­di­tional dis­charge with 12 months of re­port­ing pro­ba­tion on the two charges. At­twell has been or­dered to com­plete 50 hours of com­mu­nity ser­vice work as part of his pro­ba­tion and the court im­posed a six-month driv­ing pro­hi­bi­tion against him in re­la­tion to the charge of evad­ing po­lice.

At­twell com­mit­ted the of­fences in Kentville on Sept. 5 and Nov. 7, 2017. An­other count of fail­ing to at­tend court as re­quired was with­drawn on Nov. 13.

Im­paired driv­ing

Rae Lee Theda Giles, 31, of Ham­monds Plains, has been fined for op­er­at­ing a mo­tor ve­hi­cle while her abil­ity to do so was im­paired by al­co­hol or a drug.

Giles changed her plea to guilty to the charge on Nov. 13. Judge Christo­pher Man­ning filed Giles a to­tal of $1,560 and im­posed a one-year driv­ing pro­hi­bi­tion against her.

Giles com­mit­ted the of­fence in New Mi­nas on Aug. 26, 2017. Five counts of pos­sess­ing stolen prop­erty of a value not ex­ceed­ing $5,000 were dis­missed on Nov. 13.

Con­di­tional dis­charge for as­sault

Can­dace Lam­bert, 44, of Wolf- ville, has been handed a con­di­tional dis­charge with pro­ba­tion for com­mit­ting an as­sault.

Lam­bert pleaded guilty to the charge on Sept. 11 and the mat­ter was ad­journed to Nov. 13 to al­low time for a pre-sen­tence re­port to be pre­pared and for sen­tenc­ing. Judge Ronda Van Der Hoek handed Lam­bert a con­di­tional dis­charge with one year of pro­ba­tion.

Lam­bert com­mit­ted the of­fence in Wolfville on May 8.

Re­fused breathal­yser

Lo­rilee Ken­dra Sealby, 45, of Green­wood, has been fined for fail­ing to com­ply with a de­mand made to her by a po­lice of­fi­cer to pro­vide sam­ples of her breath for anal­y­sis to de­ter­mine the con­cen­tra­tion, if any, of al­co­hol in her blood.

Sealby pleaded not guilty in April 2017 to this charge and to a charge of op­er­at­ing a mo­tor ve­hi­cle while her blood al­co­hol level ex­ceeded the le­gal limit. The mat­ters were ad­journed for trial. The trial was held over sev­eral dates. Fur­ther ev­i­dence was heard on Oct. 30, when Sealby was ac­quit­ted on the im­paired driv­ing charge. The mat­ter of the re­fusal charge was ad­journed to Nov. 13 for a de­ci­sion.

Judge Ronda Van Der Hoek found Sealby guilty on the re­fusal charge. Sealby was fined a to­tal of $1,300 and the court im­posed a one-year driv­ing pro­hi­bi­tion against her.

Sealby com­mit­ted the of­fence at 14 Wing Green­wood on Jan. 28, 2017.

Ut­tered death threat, com­mit­ted as­sault

Devn Kale Field, 18, of Grafton, has been handed a con­di­tional dis­charge with pro­ba­tion for ut­ter­ing a death threat and com­mit­ting an as­sault.

Field was orig­i­nally charged with us­ing a weapon — an ex­ten­sion cord — in com­mit­ting an as­sault but pleaded guilty to the lesser, in­cluded of­fence of as­sault on June 14. He pleaded guilty to the charge of ut­ter­ing a death threat on July 30. The mat­ters were ad­journed to al­low time for a pre-sen­tence re­port to be pre­pared and for sen­tenc­ing.

On Nov. 15, Judge Gre­gory Lene­han handed Field a con­di­tional dis­charge with nine months of pro­ba­tion on the two charges. He was fined $100 in vic­tim sur­charges on each charge, for a to­tal of $200 in fines.

Field com­mit­ted the of­fences in Grafton on Feb. 2 and May 1. A charge of as­sault caus­ing bod­ily harm was with­drawn on Nov. 15.
