Intermittent custody
Nathan Malcolm Cox, 43, of Wolfville, has been sentenced to intermittent custody for operating a motor vehicle while disqualified from doing so.
Cox changed his plea to guilty on Sept. 19 and the matter was adjourned for sentencing. On Nov. 19, Judge Ronda Van Der Hoek sentenced Cox to 75 days of intermittent custody, to be served from Saturdays at 9 p.m. to Mondays at 6 a.m. beginning Nov. 24. Cox will be on probation while not in custody. He was fined $100 in victim surcharges and the court imposed a one-year driving prohibition against him, consecutive to one currently being served.
Cox committed the offence in Wolfville on March 28.
Conditional sentence for sexual assault
Roger William Smith, 62, of Cambridge, Kings County, has been handed a conditional sentence order with daily curfew, to be followed by probation, for committing a sexual assault.
Smith pleaded guilty to the charge on Aug. 14 and the matter was adjourned to allow time for a pre-sentence report to be prepared and for sentencing. On Nov. 21, Judge Claudine MacDonald handed Smith a three-month conditional sentence order with daily curfew from 10 p.m. to 6 a.m., to be followed by one year of probation. Smith was fined $100 in victim surcharges.
Smith committed the offence in Cambridge on May 25.
Breathalyser offence
Delbert St. Clair Arsenault, 27, of Wolfville, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit.
Arsenault pleaded guilty to the charge on Nov. 20. Judge Ronda Van Der Hoek fined Arsenault a total of $1,300 and imposed a one-year driving prohibition against him.
Arsenault committed the offence in New Minas on June 17. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Arsenault gave breathalyser readings of 90 and 100.
Breathalyser offence
Rutherford Hazen Murray, 32, of Gaspereau, has been fined for operating a motor vehicle while his blood alcohol level exceeded the legal limit.
Murray pleaded guilty to the charge on Nov. 20. Judge Ronda Van Der Hoek fined Murray a total of $1,300 and imposed a one-year driving prohibition against him.
Murray committed the offence in Wolfville on Aug. 4. The legal
blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Murray gave breathalyser readings of 100 and 90.
Conditional discharge for assault
Kristin Nicole Lee, 20, of Ardoise, has been handed a conditional discharge with probation for committing an assault.
Lee changed her plea to guilty on Nov. 19. Judge Claudine MacDonald handed Lee a conditional discharge with one year of probation.
Lee committed the offence in Brooklyn on April 10.
Conditional discharge for assault
Cyril Todd Langille, 45, of Three Mile Plains, has been handed a conditional discharge with probation for committing an assault.
Langille pleaded guilty to the charge on Aug. 14 and the matter
was adjourned to allow time for a pre-sentence report to be prepared and for sentencing. On Nov. 21, Judge Claudine MacDonald handed Langille a conditional discharge with 12 months of probation and fined him $100 in victim surcharges.
Langille committed the offence in Berwick between May 1 and 31, 2017. A charge of assault causing bodily harm was withdrawn on Nov. 21.
Undertaking, recognizance offences
Kevin Travis Harris, 22, of Kentville, has been handed a suspended sentence with probation for failing to comply with his undertaking and two counts of failing to comply with his recognizance.
Harris pleaded guilty to the charges on July 13 and the matters were adjourned to allow time for a presentence report to be prepared and for sentencing. On Nov. 19, Judge Ronda Van Der Hoek handed Harris a suspended sentence with one year of probation on the three charges.
Harris committed the offences in Kentville on Nov. 16, 2017, and on June 1 and July 6, 2018. Another count of failing to comply with his recognizance was withdrawn on Nov. 19.
