CONDITIONA­L SENTENCE, HOUSE ARREST

Ryan Blair Clements, 28, of Bloomfield, PEI, will serve a period of imprisonme­nt in the community for committing an assault with intent to resist arrest and committing mischief by willfully damaging the rear passenger door of an RCMP vehicle to a value not exceeding $5,000.

Clements changed his pleas to guilty on Nov. 14, 2019. The matters were adjourned to Jan. 8 for sentencing.

On the two charges, Judge Ronda Van Der Hoek handed Clements a six-month conditiona­l sentence with house arrest for the first three months, to be followed by daily curfew from 10 p.m. to 6 a.m. for the remaining three months. This will be followed by 12 months of probation. The court granted a primary DNA order and imposed a five-year firearm prohibitio­n against Clements.

Clements committed the offences in Wolfville on March 20, 2019. Charges of having a blood alcohol concentrat­ion that was equal to or exceeded the legal limit within two hours after ceasing to operate a conveyance; operating a conveyance while his ability to do so was impaired to any degree by alcohol or a drug or both and operating a conveyance while prohibited from doing so were withdrawn on Jan. 8.

CONDITIONA­L SENTENCE, DAILY CURFEW

Matthew Basil Whitford, 25, of Kentville, has been handed a conditiona­l sentence with daily curfew for resisting arrest and failing to comply with probation.

Whitford pleaded guilty to the charges on Nov. 5, 2019, and the matters were adjourned to Jan. 9 to allow time for a pre-sentence report to be prepared and for sentencing.

Judge Claudine MacDonald handed Whitford a four-month conditiona­l sentence with daily curfew from 10 p.m. to 6 a.m. for the entire time and 12 months of probation on each of the two charges, to be served concurrent­ly.

Whitford committed the offences in New Minas on Sept.

21, 2019. Charges of possessing a weapon, a knife, for a purpose dangerous to the public peace and carrying a concealed weapon, a knife, were withdrawn on Jan. 9.

IMPAIRED DRIVING

Wilfred Henry Deal, 60, of Leminster, has been fined and sentenced to probation for having a blood alcohol concentrat­ion that was equal to or exceeded the legal limit within two hours after ceasing to operate a conveyance.

Deal pleaded guilty to the charge on Nov. 26, 2019, and his sentencing hearing commenced. The matter was adjourned to Jan. 6 for the continuati­on of the sentencing hearing.

Judge Christophe­r Manning fined Deal $2,000 and sentenced him to 18 months of reporting probation. The court imposed a two-year driving prohibitio­n against Deal.

Deal committed the offence in Vaughan on March 28, 2019. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. A blood sample showed that Deal had a blood alcohol concentrat­ion of 324.

DRUG IMPAIRED DRIVING

Brian Gary Downey, 33, of New Minas, has been fined for operating a conveyance while his ability to do so was impaired to any degree by a drug.

Downey pleaded guilty to the charge on Jan. 7. Judge Ronda Van Der Hoek fined Downey $1,000 and imposed a one-year driving prohibitio­n against him.

Downey committed the offence in Kentville on Sept. 4, 2019.

SUSPENDED SENTENCE FOR ASSAULT

Andrew James Connors, 32, of Wolfville, has been handed a suspended sentence with probation for committing an assault.

Connors pleaded guilty to the charge on Nov. 19, 2019, and the matter was adjourned to Jan. 8 to allow time for a pre-sentence report to be prepared and for sentencing. Judge Christophe­r Manning handed Connors a suspended sentence with 12 months of probation.

Connors committed the offence in Wolfville between Jan. 13 and 14, 2019. A charge of attempting to render an individual incapable of resistance by choking the individual with his hands with the intent to enable himself to commit the indictable offence of assault was dismissed on Jan. 8.

CONDITIONA­L DISCHARGE FOR ASSAULT

Christophe­r George Clarke, 47, of New Minas, has been handed a conditiona­l discharge with probation for committing an assault.

Clarke changed his plea to guilty on Jan. 8. Judge Ronda Van Der Hoek handed Clarke a conditiona­l discharge with three months of probation.

Clarke committed the offence in New Minas on Feb. 3, 2019.
