FEDERAL SENTENCE FOR AGGRAVATED ASSAULT

William Wack, 25, of Auburn, has been sentenced to federal time after being found guilty of maiming an individual, thereby committing aggravated assault. Wack also pleaded guilty to two counts of failing to comply with probation.

On Sept. 26, Wack pleaded not guilty to the three charges and to charges of using a weapon, a blunt object, in committing an assault; and a third count of failing to comply with probation.

A trial began on Oct. 13. Wack changed his pleas to guilty on two counts of failing to comply with probation. On Dec. 12, the trial continued on the remaining charges.

On Jan. 3, a decision was rendered. Wack was found guilty of aggravated assault and using a weapon in committing an assault. The matters were adjourned to allow time for a pre-sentence report to be prepared and for sentencing.

Wack was present in provincial court in custody on Feb. 13. Judge Angela Caseley sentenced Wack to four years in federal custody on the aggravated assault charge. After receiving credit for time remanded in custody, Wack has two years and 293 days remaining to serve.

Wack was sentenced to 30 days in custody, to be served concurrent­ly, on each of the two counts of failing to comply with probation that he pleaded guilty to.

The court entered a stay of proceeding­s on the charge of using a weapon in committing an assault. The third count of failing to comply with probation was dismissed on Feb. 13 with the Crown offering no evidence.

Wack committed the offences in Auburn on July 6, 2023.

JAIL TIME FOR THREE OFFENCES

Scott Moore, 54, of Berwick, has been sentenced to jail time after pleading guilty to charges of assault causing bodily harm; unlawful confinemen­t; and failing to comply with a condition of a release order, to have no contact or communicat­ion with an individual.

Moore changed his pleas to guilty on Dec. 6. The matters were adjourned to allow time for a pre-sentence report to be updated and for sentencing.

Moore was present in provincial court in custody on Feb. 12. Judge Angela Caseley sentenced Moore to nine months in custody, or 270 days, on the assault causing bodily harm charge. Moore was given credit at timeand-a-half for 156 days spent remanded in custody, or 234 days, leaving one month and six days to serve.

Moore was handed a 10year mandatory firearms prohibitio­n on the assault causing bodily harm charge.

Moore was sentenced to two months in custody, to be served consecutiv­ely, on the unlawful confinemen­t charge; and one month, to be served consecutiv­ely, on the release order charge, for a total of four months and six days to serve. Moore was also sentenced to 30 months of probation on the three charges.

Moore committed the offences in Berwick on Aug. 30, 2023. Charges of choking an individual in committing an assault and another count of failing to comply with a condition of a release order were dismissed on Feb. 12.

INTERMITTE­NT CUSTODY FOR REFUSING DEMAND

Laura Lee Medicraft, 53, of South Alton, has been sentenced to intermitte­nt custody for failing to comply with a demand made to her by a peace officer to provide samples of her breath for analysis to determine the concentrat­ion, if any, of alcohol in her blood.

Medicraft pleaded guilty to the charge on Dec. 13. The matter was adjourned for sentencing.

On Feb. 12, Judge Angela Caseley sentenced Medicraft to 30 days of intermitte­nt custody, beginning Friday, Feb. 16, at 6 p.m. until Monday, Feb. 19, at 6 a.m. and continuing every weekend until the sentence is served.

Medicraft was also sentenced to 12 months of probation and the court imposed a two-year driving prohibitio­n against her.

Medicraft committed the offence in Kentville on Oct. 7, 2022.

CONDITIONA­L SENTENCE FOR MISLEADING OFFICER

Chelsea Cook, 30, of Centrevill­e, has been handed a conditiona­l sentence after pleading guilty to, with intent to mislead, causing a peace officer to enter or continue an investigat­ion by making a false statement that accused an individual of having committed the offence of assault.

Cook pleaded guilty to the charge on Nov. 23. The matter was adjourned to Feb. 7 to allow time for a pre-sentence report to be prepared and for sentencing.

Judge Angela Caseley handed Cook a 30-day conditiona­l sentence order with daily curfew from 10 p.m. to 7 a.m. for the entire time. The conditiona­l sentence will be followed by 12 months of probation.

Cook committed the offence in Halifax between Oct. 16, 2022, and March 14, 2023. A charge of failing to comply with probation was dismissed on Feb. 7.

IMPAIRED DRIVING, FAILED TO STOP VEHICLE

Jessica Ellen LePage, 42, of Kentville, has been fined and sentenced to probation after pleading guilty to two charges.

They include having a blood alcohol concentrat­ion that was equal to or exceeded the legal limit within two hours of ceasing to operate a conveyance; and failing to stop her conveyance, give her name and address, and offer assistance after having been involved in an accident.

LePage pleaded guilty to the charges on Feb. 7. Judge Angela Caseley fined LePage $2,500 on the impaired driving charge and imposed a one-year driving prohibitio­n against her. LePage was sentenced to 18 months of probation for failing to stop after being involved in an accident.

LePage committed the offences in Kentville on Nov. 10, 2022. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. LePage gave blood alcohol readings of 310 and 290.

A charge of operating a conveyance while her ability to do so was impaired to any degree by alcohol or a drug or both was withdrawn on Feb. 7.

CONDITIONA­L SENTENCE FOR IMPAIRED DRIVING

William Edward Sullivan, 54, of Aylesford, has been handed a conditiona­l sentence after pleading guilty to having a blood alcohol concentrat­ion that was equal to or exceeded the legal limit within two hours of ceasing to operate a conveyance.

Sullivan pleaded guilty to the charge on Feb. 8. Judge Ronda Van Der Hoek handed Sullivan a 90-day conditiona­l sentence order with house arrest for the first 60 days. Sullivan was also sentenced to 18 months of probation and the court imposed a three-year driving prohibitio­n against Sullivan.

Sullivan committed the offence in Somerset on Feb. 11, 2023. The legal blood alcohol limit is 80 mg of alcohol in

100 ml of blood. Sullivan’s blood alcohol readings were not available.

A charge of operating a conveyance while his ability to do so was impaired by alcohol was withdrawn on Feb. 8.

FINE, PROBATION FOR REFUSING DEMAND

Jane Arenburg, 55, of Centrevill­e, has been fined and sentenced to probation for failing or refusing to comply with a demand made by a peace officer under Section 320.27 or 320.28 of the Criminal Code. These sections relate to screening drivers for the presence of alcohol and drugs.

Arenburg pleaded guilty to the charge on Feb. 7. Judge Angela Caseley fined Arenburg $3,000 and imposed an 18-month driving prohibitio­n against her. Arenburg was also sentenced to 18 months of probation.

Arenburg committed the offence in New Minas on Aug. 18. A charge of operating a conveyance while her ability to do so was impaired to any degree by alcohol or a drug or both was withdrawn on Feb.

REFUSED DEMAND, DROVE WHILE PROHIBITED

Alexander Wesley Stewart,

25, of Woodville, has been sentenced to intermitte­nt custody for failing to comply with a demand made to him by a peace officer to provide samples of his breath for analysis to determine the concentrat­ion, if any, of alcohol in his blood; and has been fined for operating a conveyance while prohibited from doing so.

Stewart pleaded guilty to the charges on Feb. 7. On the charge of failing to comply with a demand, Judge Angela Caseley sentenced Stewart to 30 days of intermitte­nt custody. The time will be served beginning Friday, Feb. 16, at 6 p.m. to Monday, Feb. 19, at 6 a.m. and continuing every weekend thereafter until the sentence is served.

Stewart was also sentenced to 18 months of probation and the court imposed a three-year driving prohibitio­n against him.

Stewart was fined $2,000 for operating a conveyance while prohibited from doing so.

Stewart committed the offences in Coldbrook on March 20. A charge of operating a conveyance while his ability to do so was impaired to any degree by alcohol or a drug or both was withdrawn on Feb. 7.

FINED FOR IMPAIRED DRIVING

Gregory Benjamin, 45, of Canning, has been fined for having a blood alcohol concentrat­ion that was equal to or exceeded the legal limit within two hours after ceasing to operate a conveyance.

Benjamin pleaded guilty to the charge on Feb. 7. Judge Angela Caseley fined Benjamin $1,000 and imposed a one-year driving prohibitio­n against him.

Benjamin committed the offence in New Minas on Sept. 23. The legal blood alcohol limit is 80 mg of alcohol in 100 ml of blood. Benjamin gave blood alcohol readings of 110 and 110.

A charge of operating a conveyance while his ability to do so was impaired to any degree by alcohol or a drug or both was withdrawn on Feb. 7.
