Internet Platform Monopolization Regulation

Abstract：With the deep integration of information communication technology and digital data technology ，popularization and application of software and hardware facilities such as Internet of things ，big data，cloud computing，artificial intelligence algorithm and mobile terminal，and the continuous development and innovation of the new economic form，new technology industry，and new business model，the platform economy，a new economic form，is gradually becoming a new industry and new energy to promote the rapid development of China's economy. Under the enabling of big data ，artificial intelligence algorithm， edge computing and other data technologies，platform bilateral or multilateral structure，and direct and / or indirect network effects and other elements and features，data and algorithms has become the important driving force for the rapid development of platform economy and its innovative business model. At the same time ，it also constitutes a two- wheeled facility which is the driving force of platform development. Under the two-wheeled driven of data and algorithms ，platform enterprises are often able to continuously strengthen or even solidify the feedback loop of their market power by advantages in data and algorithms ，and forming a firm lock- in effect on the front- end and back- end markets ，as a result，the platform economy presents a more and more obvious trend or actual state of the“two- wheeled monopoly”. In order to avoid the actual harm or potential threat to the competition order，enterprise innovation and users' interests caused by the " two-wheeled monopoly" ，laws and policies related to competition law should be revised or improved o effectively promote the market competition of data elements ，and the regulatory authorities should reasonably regulate the behaviors of abusing the dominant power or comparative advantage of the data market，such as data blockade，data monopoly，data hegemony，etc.；and it should scientifically build the multi-governing model by the guide of the systematic concept，plan the important value of development and security in the standardized development platform economy，cultivate and support the compliance awareness and behavior of platform enterprises ，especially the super platform enterprises，in the process of data collection，use and management. While strengthening the competition supervision in the field of platform economy in accordance with the law ，regulatory authorities should also adhere to both scientific & cautious and open & up supervision，avoid the improper intervention of“innovation competition”and“competitive innovation”in the field of platform economy，and to realize the integration of the efficient market and the effective government.
