MBABANE - A 46-year-old man of Maphalaleni yesterday found himself at the Mbabane Magistrates Court after assaulting another man over adultery allegations.

Sipho Amos Maphosa, under Chief Mashila in the Hhohho Region, allegedly committed the offence at Gobholo on Sunday. The accused appeared before Magistrate Chazile Thwala.

The accused assaulted Dumsani Dlamini with a stick several times on the body. After the charge sheet was presented before the magistrate, the accused pleaded guilty to the charge.

Prosecutor Sithole, who represented the accused, told the court that he was in the court as the result of adultery allegations between his wife and the complainant.

He further told the court that the accused was told that he should have reported the matter, instead of taking the law into his own hands.

“Pleading guilty by the accused has shown being remorseful and a realisation of the mistake he had committed. Also the Crown had submitted that he is a first time offender. He, therefore, deserves that degree of lenience,” said Sithole.

Married

Sithole further told the court that the accused was married to one wife with four children, who were all dependent on him.

He further mentioned that the accused’s eldest son was in high school. He further highlight that his marriage was on the brink of falling apart.

The accused was sentenced to two years imprisonment with an option to pay a fine of E2 000.

However, half of the sentence was suspended for a period of a year, on condition that the accused does not commit the same offence during such period.
