MBABANE - Global Paints t/a Global Coating (PTY) LTD has taken Baceth Hardware to court for allegedly failing to pay a sum of over E580 000.

Hosea Member of Parliament (MP) Mduduzi Bacede Mabuza is the second respondent in the matter, as surety and Co-Principal Debtor of Baceth Hardware.

Global Paints wants the court to instruct Baceth Hardware and the 2nd respondent to pay the sum of E587 591.26, plus nine per cent interest per annum allegedly owed to them.

In their applicatio­n, they also want the court to instruct the latter to pay the cost of their legal fees at their own scale.

Global Paints said on or about October 13, 2018, they entered into a written Credit Sale Agreement (CSA) with Baceth Hardware in which they agreed to sell Global Paints goods on credit.

As per the terms of the agreement, Global Paints said Baceth Hardware would sell goods belonging to them, the rate and prices used for the sales were that of Baceth Hardware.

“Baceth Hardware would then issue an invoice for the goods sold and delivered,” said Global Paints, in their court documents.

They also said all goods they sold to Baceth Hardware were expected to be paid within thirty days of receipt of invoice.

“In the event of any default in payment of any amount due and owing, the full balance outstandin­g would become due and payable as per the agreement,” said Global Paints.

They further mentioned that Mabuza, as surety and Co-Principal Debtor of Baceth Hardware, would be bound jointly and severally in solidum with the company and all its obligation­s.

“We sold and delivered goods to Baceth Hardware at its own special instance and request on the aforesaid terms between December 2021 to January 2022 for the sum of E587 591.26.” they said.

Global Paints also mentioned that Baceth Hardware was neglecting or refusing to pay the amount owed to them.
