Student who killed mum guilty of culpable homicide

M– The student who killed her mother has escaped with a lesser charge of culpable homicide Caroline Kyara (20).

Kyara who was an Economics student at a university situated in Cyprus, South of Turkey is said to have killed her mother by stabbing her with knife while they were in a rented flat in Manzini.

The incident happened immediatel­y after Aminia, a teacher by profession, had held a prayer session for her daughter for safe travel back to school overseas.

Acting High Court Judge Fikile Nhlabatsi, who heard the matter yesterday, found the accused not guilty of murder but guilty of culpable.

She found that the accused had no intention, either direct or indirect, to kill the deceased but she was negligent because she could not appreciate or foresee that death could occur in the state of mind that she was in.

The court also found that the evidence of the Crown, in particular that of witness No.2 and 4 proved that the deceased was high and could not appreciate her conduct.

Caroline who is represente­d by Noncedo Ndlangaman­dla is now expected to mitigate on sentence. When the incident happened in 2018, it was reported that prior to meeting her death, Aminia had contacted her friend and colleague to come to her place as she had suspected that her child was going through a lot and needed to be prayed for, especially because she was leaving for school.

“When the friend arrived at the SNPF flats, Aminia requested that they all pray as her child had not been herself of late. She stated that Caroline had not been eating the whole week and had also been behaving strangely.

“They started praying inside the house, something which did not go down well with Caroline, who had already packed her suitcases and was ready for her trip to Sikhuphe, where she was supposed to connect to OR Tambo Internatio­nal Airport,” said the source when he was interviewe­d after the incident.

The source said while praying, Caroline got violent and ordered that they go and pray outside as they were making noise. Before the prayer session, she had ordered that her mother drive her to the airport, instead of calling the taxi.

“She did not want to go to the airport by taxi; she wanted her mother to take her there. She even asked why they had a car if her mother could not take her to the airport. Her mother, who had just parked the car after returning from school, told her she had already called the taxi and it was on its way,” the source said.
