months. He alleged that after sometime, Makama called to inform him that he was still trying to get the money and that in the meantime he should fix the motor vehicle. These are allegation­s whose veracity is still to be tested in court and the respondent­s ( the commission­er and Makama) are yet to file their papers in the events they intend to rebut the allegation­s contained in Matse’s applicatio­n.

“Upon completion of the aforesaid task, I informed Makama that the car engine had been fixed and was ready for collection. He promised to come with the balance of E13 400. I waited for him to come and collect his motor vehicle for a period of three months until I sent a message threatenin­g him that his failure to collect the car will attract storage fees of E100 per day,” he argued.

He alleged that Makama later came and requested to pay E9 000 but failed to do so as he paid him E6 500.

“After they had taken the car, I received a call from Makama, telling me that the water pump was not new and demanded that I should refund him E1 500. I wish to aver that when he mentioned that, I knew that it was a strategy to avoid paying me the balance of E6 900 for fixing the motor vehicle, I told him in no uncertain terms that he should just bring the car so that I can remove the parts,” he argued. Matse said that was when he changed the narrative that if he (Matse) removed the parts, he should as well return the deposit he paid, which was the sum of E7 600. “I wish to aver that for peace sake, I agreed to refund him the deposit but on condition he returned all the parts, which he never returned till to date,” he argued. The matter is still pending at the High Court and appearing for the applicant are lawyers from Rodrigues and Associates in Manzini.
