MBABANE – Businessman Sean Blignaut informed the court that he had gathered reliable information that Moira had allegedly transferred some of the money to Nelspruit, South Africa, to his prejudice.
“This is actually tantamount to fraud as much as the applicant was or could be named a beneficiary in the life policy, but because there was a joint will that she also signed, which specifically stated that life insurance policy should be distributed accordingly. Applicant ought to have forwarded it in terms of Section 41 of the Administration of Estates Act.’’
Sean stated that the executor had already published for objection the First and Final Liquidation and Distribution Account on February 21, 2023 and he had accordingly objected to it. He also mentioned that the LiquidationAccount did not includePlotNo.261,NkonyeniGolf Estate, Sidvokodvo worth E4 570 000, which is held by the Blignaut D. Family Trust, where Sean said he was the surviving Trust Beneficiary, together with Moira. He pointed out that he and his mother were the only surviving beneficiaries of the Blignaut D. Family Trust, which owned Plot No.261, Nkonyeni.
Premises
“I, therefore, have a clear right to access these premises as Nkonyeni is also my family home as the beneficiary of the Blignaut D. Family Trust. Busi Quip (Pty) Ltd is my family business, which I have natured and worked for with my father Don Blignaut.’’
Sean further accused Moira of coming to court with dirty hands. He said she abused court processes as she had allegedly unilaterally removed him from all operations and portals of Busi Quip (Pty) Ltd, without his knowledge and/or consent. “She has taken the law into her own hands and now wants this Honourable Court to endorse her contravention of the Audi alteram partem (right to be heard) rule. I have just decided to take a back seat for now because this is my biological mother.”
Sean also said Moira gave security guards employed by Crime Stop Security specific instructions not to allow him into all the premises which he had a direct and substantial interest. He said there was no logic in denying him access into his family business and/or a company which he owned. He also alleged that Moira deprived him of his monthly allowance of E30 000 from the business without his consent. He alleged that she currently gave him E9 000 instead of E30 000. Moira is represented by Alwyn Dupont of Dupont Attorneys. The matter is pending in court.
