Husband Accused of Raping Wife

Awoman at the Suva High Court yesterday gave evidence of how her husband allegedly had anal sexual intercours­e with her despite her saying no.

The mother of six children gave evidence before the Suva High Court Judge Justice Thushara Rajasinghe.

The incident allegedly occurred in a bushy area at Kadavu after an unsuccessf­ul fishing session of the couple last year in March.

The victim told the court that she and her husband had gone fishing five minutes away from their home.

However, because they had not caught any fish, she claimed that her husband smacked her on her head and stomach.

After that they both went to get breadfruit from a busy place. There she said the accused told her that he wanted to have sex. She said she consented to normal sex.

But later, she said the accused asked to anally penetrate her. It was here when she disagreed to and said no.

But despite her ‘NO’ she alleged, her husband continued to do so. The victim further said the pain was not bearable, however, she could not stop him because he had punched her again at the time of the incident.

She added she was scared that the accused might hurt her more.

Thereafter, the victim said she left him and since then had come to Suva and was now residing at 8 miles with two of her children. The accused is charged for 1 count of Rape contrary to section 207(1) and (2)(b) and 1 count of assault causing actual bodily harm contrary to section 275 of the Crimes Decree 2009.
