Awoman accusing her husband of rape told the court yesterday that she did not consent to sexual intercourse on numerous occasions when her husband allegedly raped her regardless of her refusing.

The accused, 31, is charged with four counts of rape.

The matter was heard before Judge Justice Riyaaz Hamza at the Suva High Court yesterday.

The accused is alleged to have raped his wife with an eggplant. The alleged incident occurred between November 30, 2015 and January 5, 2016. State counsel Shirley Tivao asked the wife how was her relationship with her husband.

The wife told the court that the first two years of their marriage was really smooth but after that the couple had a lot of arguments which ended with the husband allegedly forcing her into sex. She further told the court that on one occasion when she returned home at 5pm after work the couple had dinner then went to bed and again they started arguing. She alleges that her husband asked to have sex but she refused claiming to be tired from work.

“We argued and he forcefully had sex with me two times and because I was pushing him off he got aggressive and put an eggplant inside; at first I felt something different but I didn’t know it was an eggplant until I switched on the lights and saw the eggplant beside the bed,” she said.

During cross-examination defence counsel Talei Kean questioned the wife on why she had not told the Police that he was aggressive to which she said that she did but the Police had not noted it down. The case continues today.
