Court dis­charges bur­glary ac­cused

Two men charged with ag­gra­vated bur­glary and theft were dis­charged by the High Court in Suva yes­ter­day. On April 14, 2018, the duo Me­sake Na­vatoga, 20, and Semi Rakai, 20, al­legedly un­law­fully en­tered the vic­tim’s home in Toorak and stole cash amount­ing to $3250 and as­sorted jewellery val­ued at $33,742. They ap­peared be­fore Jus­tice Daniel Goundar and were rep­re­sented by Le­gal Aid lawyer Li­tiana Rati­dara.

State lawyer Su­jata Lod­hia made an ap­pli­ca­tion for a nolle prosequi for both ac­cused and in­formed Jus­tice Goundar that the State faced issues in re­la­tion to the iden­ti­fi­ca­tion of the two ac­cused men. Ms Lod­hia said none of the stolen items were re­cov­ered.

She said Na­vatoga had a pre­vi­ous con­vic­tion for theft.

Ms Rati­dara told the court that Rakai had no pend­ing mat­ters. Ac­cord­ingly Jus­tice Goundar ac­cepted the State’s ap­pli­ca­tion and dis­charged the two men from pro­ceed­ings.
