Woman tells court: Ac­cused forced me to per­form sex­ual acts

Acom­plainant has told court that she was forced to per­form sex­ual acts on the ac­cused.

This was heard dur­ing the trial of a for­mer Na­tional Fed­er­a­tion Party pro­vi­sional can­di­date charged with 11 counts of sex­u­ally-re­lated of­fences. The trial started at the High Court in Suva on Mon­day.

The 66-year-old man is charged with four counts of rape and seven counts of sex­ual as­sault.

The ac­cused ap­peared be­fore the presiding trial Judge Justice Thushara Ra­jas­inghe.

It is al­leged that the man raped his 54-year-old sister-in-law in Suva on June 28, last year.

It is al­leged the man ap­proached the woman and asked if he could spend the night at her house be­cause he was too tired af­ter a wed­ding and could not go back home. The man al­legedly started knock­ing on the woman’s bed­room door in the mid­dle of the night and then force­fully got into the room.

He then al­legedly raped the woman. The woman man­aged to free her­self and locked the man in the bath­room and sought help from a friend who then in­formed the Po­lice. State pros­e­cu­tion is rep­re­sented by Swastika Sharma from the Of­fice of the Di­rec­tor of Pub­lic Prose­cu­tions.

The ac­cused is rep­re­sented by lawyers De­vanesh Sharma and his as­so­ci­ate Sharoneel Deo.

In court on Mon­day, the com­plainant gave ev­i­dence as the pros­e­cu­tion’s first wit­ness.

The com­plainant told the court that she was 54 years old and stayed at home, liv­ing with her daugh­ter in Suva.

She also told the court that she was a mother of three chil­dren and her hus­band died in 2011. The com­plainant told the court that the ac­cused had told her that he would be trav­el­ling to Suva to at­tend a wed­ding with his fam­ily. She told the court that on June 27, 2018, she was at her daugh­ter’s house when she had a missed call from the ac­cused at about 11am. When she saw the missed call, she called him back.

She also said that on the day of the al­leged in­ci­dent, she was alone at home when the ac­cused went to her house.

In court yes­ter­day, the com­plainant nar­rated the al­leged in­ci­dent and of how it took place in her son’s bed­room. She told the court that the ac­cused had forced her and pushed her to per­form sex­ual acts on her.

She also told the court that she was scared be­cause the ac­cused threat­ened to kill her if she raise an alarm.

The com­plainant also said that the ac­cused had told her that he had done the same with other women.

She told the court that she did not give any form of con­sent to the ac­cused to per­form sex­ual acts.

The trial con­tin­ues be­fore Justice Ra­jas­inghe to­day.
