El­derly woman, 2 men charged with two counts of rape

Two men and an el­derly woman charged with two counts of rape will have their trial at the High Court, Labasa in Novem­ber.

The al­leged in­ci­dent took place in Jan­uary 2010 when the el­derly woman al­legedly aided and abet­ted the rape of her grand­daugh­ter who was eight months pregnant in

or­der to ter­mi­nate the preg­nancy.

A trial in the case had started with the vic­tim giv­ing ev­i­dence on Mon­day. How­ever, the state pros­e­cu­tion had asked the court if the charges could be amended. The amended charges were read to the three ac­cused in Hindi. The three ac­cused said they un­der­stood the charges and pleaded not guilty.

The el­derly man and woman in this case are rep­re­sented by dif­fer­ent lawyers from the Le­gal Aid Com­mis­sion while the third ac­cused has pri­vate coun­sel.

All par­ties have agreed to have the trial from Novem­ber 19. Mag­is­trate Cama Tu­beri said it was the only avail­able date in his diary as all dates for this year had been taken up.

The pros­e­cu­tion in­formed the court that they would be pre­sent­ing two wit­nesses in the trial.
