Latchan appeals director conviction
Rohit Ram Latchan, who was fined $500 for being guilty of two counts of undischarged bankrupt acting a director, has appealed his conviction.
Latchan appeared before Judge Justice Riyaz Hamza yesterday. Latchan was found guilty of two counts of undischarged bankrupt acting as a director and sentenced by the Magistrates Court in Suva on March 3. In the appeal, Latchan’s counsel highlighted that the learned Magistrates erred in law and in fact by entering a conviction against Latchan and failing to exercise his discretion under the Sentencing and Penalties Act.
Latchan’s counsel told the court that the appeal was on the conviction only and not on the fine.
Justice Hamza has adjourned the matter for the appellant and respondent counsels to check the court briefs before time to file submissions were given.
The matter will now be called on June 10.
