State to Relook at Evidences in Case

Justice Vinsent Perera yesterday told prosecutio­n that it would have to prove beyond reasonable doubt that an axe was allegedly used as a murder weapon. This is in the case of Fabiano Dakai, who is charged with the murder of Timoci Dogai, a security guard of Waidradra on February 4, 2019.

The judge questioned the prosecutor, Kimberly Semisi, from the Office of the Director of Public Prosecutio­n.

Ms Semisi told the court that the accused had asked a Mr Semi for his axe and taken it from his residence.

Ms Semisi told the court that the axe found had not been examined and that the accused was arrested

a few days after the death of deceased.

She told the court that she would need to get an additional statement on the cause of death from the pathologis­t who had conducted the post-mortem examinatio­n of the deceased.

This is because the post-mortem report stated sharp trauma which the should have been blunt trauma.

Symptoms of medical illness

Ms Semisi also told the court that the accused showed symptoms of medical illness when medicallye­xamined in February 2019 before the caution interview had been conducted by the Police.

Defence counsel from the Legal Aid Commission, Namrata Mishra told the court that the defence would file a voir dire challenge for the alleged confession­s in the record of interview.

The matter has been adjourned until April 19 for the state and defence to file their necessary applicatio­ns.

Dakai has been remanded in custody by the High Court in Suva.
