On ne naît pas soumis, on le devient
No one is born submissive, it happens
À en juger par ses cris perçants, ses pleurs, ses petits poings serrés, le nouveau-né arraché au rien, quand il déboule dans le monde, vu ses protestations rageuses, n’a rien d’un soumis. Comment va-t-il éventuellement le devenir, lui, voire son pays, un peuple tout entier ? Des écrivains, des philosophes, se sont penchés sur la question ( Discours de la servitude volontaire de La Boétie, Soumission de Michel Houellebecq). En une époque agitée où croît la menace populiste, l’appel à une Europe unie, démocratique, connaît quelques couacs qui ont de quoi inquiéter tous ceux qui sont attachés à la liberté d’expression, en premier les écrivains et les journalistes. Voici un récent de ces couacs que nous devons à une auguste institution européenne, la Cour européenne des Droits de l’Homme. L’affaire, étrangement, a peu trouvé d’écho dans les médias français. Notre attention a été attirée sur elle par une amie et collaboratrice d’artpress, Houria Abdelouahed (1), psychanalyste d’origine marocaine, qui nous a signalé un article signé Soeren Kern, publié sur le site du Galestone Institute de New York, article qui livrait le déroulé et les conclusions des casuistiques acrobaties de ladite CEDH. Résumons. Lors d’un séminaire qui s’est tenu en Autriche, au Freedom Education Institute, une intervenante, Elisabeth Sabaditsch-Wolff, dans un débat sur les dangers de l’islam fondamentaliste, a suggéré que Mahomet, d’avoir épousé Aïcha à l’âge de 6 ou 7 ans (pré-pubère et lui, le Prophète, âgé de 56 ans), et d’avoir consommé le mariage quand elle a eu 9 ans, pourrait être considéré comme pédophile. Des plaintes ont été portées contre Sabaditsch-Wolff par un tribunal autrichien pour « dénigrement de doctrines religieuses ». Condamnée en première instance et en appel en 2011, l’inculpée a porté l’affaire devant la Cour européenne des Droits de l’Homme qui a confirmé le jugement des magistrats autrichiens, ses désignations étant, paraît-il, juridiquement contraignantes, pour vingt-huit des pays membres. En dépit de ses dénégations, la CEDH a ainsi légitimé le code islamique de la charia sur le blasphème, en considérant que Sabaditsch-Wolff devait être poursuivie dans le souci de « préserver la paix religieuse en Europe », et son arrêt la condamnant, rendu le 25 octobre 2018, étant justifié ainsi : « incitation à la haine », « propos ne relevant pas du droit à la liberté d’expression ». Ce qui ne manque pas de sel venant d’une institution dont le principe fondateur était de contribuer « à une Europe démocratique, dans laquelle les droits humains et les libertés fondamentales avaient une grande importance ». Est-il besoin de préciser que cet arrêt a été chaleureusement salué par l’OCI (Organisation de la coopération islamique). Une telle plainte n’aurait-elle pas dû, d’entrée, être repoussée pour la simple raison que l’incrimination de blasphème à quoi revenait la décision des participants à ce bal de faux-culs de la Cour de Strasbourg, n’avait en l’occurrence aucun sens ? Faut-il rappeler qu’il n’y a blasphème que commis au sein de la religion à laquelle on appartient. Seul un musulman, ou un chrétien, peut être reconnu coupable de blasphémer par ses pairs. Évidemment pas les journalistes de Charlie Hebdo, par exemple, qui conchiaient joyeusement le Saint-Père et Mahomet. Comment interpréter le comportement de ces juges européens ? Irresponsabilité devant la montée du fondamentalisme islamiste en Europe, plaisir masochiste de la soumission, lâcheté ? Ajoutons, pour compléter le désolant tableau : l’évêque de Vienne, dans le rôle de « l’idiot utile », portant le coup de grâce à la condamnée. Devant un pareil spectacle, toujours un désir d’Europe ? Ouais…

In a turbulent time of growing populist threat, there are hiccups on the path to a united, democratic Europe that are worrying to all those who are committed to freedom of expression, in particular writers and journalists. Here is one recent blunder that we owe to an august European institution, the European Court of Human Rights. Strangely enough the case received little coverage in French media. Friend and artpress collaborator, Houria Abdelouahed,(1) a psychoanalyst originally from Morocco, brought our attention to an article by Soeren Kern, published on the site of the Gatestone Institute in New York, on the proceedings and conclusions of the aforementioned ECHR’s acrobatic casuistics. To summarize. At a conference at the Freedom Education Institute in Austria, one of the speakers Elisabeth Sabaditsch-Wolff, during a debate on the dangers of Islamic fundamentalism, suggested that Muhammad married Aisha at the age of six or seven (pre-pubertal and he, the Prophet, aged fifty-six), and to have consummated the marriage when she was nine, and so be considered a paedophile. Complaints were brought against Sabaditsch-Wolff in an Austrian court for ‘denigrating religious doctrines’. Convicted in the first instance and on appeal in 2011, the accused brought the case before the European Court of Human Rights, which upheld the Austrian magistrates’ judgement, legally binding for the twenty-eight member countries. Despite its denials, the ECHR has therefore legitimized Islamic Shariah code on blasphemy, considering that Sabaditsch-Wolff should be prosecuted in order to ‘preserve religious peace in Europe’, and its judgement condemning her, delivered on 25 October 2018, being justified thus: ‘incitement to hatred’, ‘statements not within the scope of the “right to freedom of expression”’. This is interesting from an institution whose founding principle was to contribute ‘to a democratic Europe in which human rights and fundamental freedoms are of great importance’. Needless to say the decision was welocmed by the OIC (Islamic Cooperation Organization). Should such a complaint not have been rejected from the outset for the simple reason that in this case blasphemy as an offence, which is what the decision of the participants in this masquerade by the hypocrites of the Strasbourg Court, made no sense? Need I remind you that blasphemy can only be committed within the religion to which you belong? Only a Muslim or a Christian can be found guilty of blasphemy by their peers. Not the journalists of Charlie Hebdo, for example, who joyfully conjured up Saint Peter and Muhammad. How should the behaviour of these European judges be interpreted? Irresponsibility in the face of rising Islamist fundamentalism in Europe, masochistic pleasure in submission, cowardice? To complete this sad picture, let me add: the Bishop of Vienna, in the role of ‘useful idiot’, striking the condemned woman with the death blow. In the face of such a spectacle, should there still be a desire for Europe? Yeah …
