I booked a flat with Unitech (Harmony) in July 2011 on cash-down payment basis at the cost of Rs 1.75 crore. Handover of the flat was promised by the last day of December in the same year. As per the agreement, Unitech is liable to pay Rs 5 per square foot in case of delay. As of now, the work on the site is virtually at a standstill. Repeated promises obtained in writing have not materialized. Arun Kapoor There are cases where consumer forums have fined builders for not delivering the flat as per the agreement. They have been directed to refund the deposited money with interest at the rate of 18 per cent per annum. In your case, give a notice to the managing director of Unitech for committing default as per agreement and claim refund or the agreed payable interest. If the company fails to respond, you may lodge a formal complaint at the district consumer forum.
