G) Administrative control varies: There is absence of clarity with regard to the exercise of administrative and disciplinary control mainly because the principles of governing the functioning of the district fora differ from state to state.

The Supreme Court criticism was pointed and clear, and it passed specific order on each of these points. It has directed the union government to frame model rules for adoption by the state governments for the purpose of ensuring uniformity in appointments. The rules shall be framed within four months and submitted in the court for approval. The model rules shall provide: objective norms for implementing the provisions of Section 10 (1) (b), Section 16 (1) (b) and Section 20 (1) (b) with regard to the appointment of members of district fora, state commissions and National Commission guidelines for payment of salary, allowances and conditions of service commensurate with the nature of adjudicatory duties and keeping in mind the need to attract suitable talent to the adjudicating bodies. These rules shall be finalised upon due consultation with the president of the National Consumer Disputes Redressal Commission The court also requested the National Consumer Disputes Redressal Commission to formulate regulations under Section 30A, with the previous approval of the central government, within a period of three months in order to effectuate the power of administrative control vested in the National Commission over the state commissions under Section 24 (B) (1) (iii), and in respect of the administrative control of the state commissions over the district fora under Section 24 (B) (2). These rules will then be sent to the state governments for adoption in three months.

There cannot be two maximum retail prices (MRPs) for the same packaged item within a state, the consumer affairs department has said in its advisory to state governments. So, in addition to bottled water, no packaged items, including beverages, can be sold at two different MRPs in shops, multiplexes, or airports.
