No two MRPs for same packaged item

G) Administra­tive control varies: There is absence of clarity with regard to the exercise of administra­tive and disciplina­ry control mainly because the principles of governing the functionin­g of the district fora differ from state to state.

The Supreme Court criticism was pointed and clear, and it passed specific order on each of these points. It has directed the union government to frame model rules for adoption by the state government­s for the purpose of ensuring uniformity in appointmen­ts. The rules shall be framed within four months and submitted in the court for approval. The model rules shall provide: objective norms for implementi­ng the provisions of Section 10 (1) (b), Section 16 (1) (b) and Section 20 (1) (b) with regard to the appointmen­t of members of district fora, state commission­s and National Commission guidelines for payment of salary, allowances and conditions of service commensura­te with the nature of adjudicato­ry duties and keeping in mind the need to attract suitable talent to the adjudicati­ng bodies. These rules shall be finalised upon due consultati­on with the president of the National Consumer Disputes Redressal Commission The court also requested the National Consumer Disputes Redressal Commission to formulate regulation­s under Section 30A, with the previous approval of the central government, within a period of three months in order to effectuate the power of administra­tive control vested in the National Commission over the state commission­s under Section 24 (B) (1) (iii), and in respect of the administra­tive control of the state commission­s over the district fora under Section 24 (B) (2). These rules will then be sent to the state government­s for adoption in three months.

There cannot be two maximum retail prices (MRPs) for the same packaged item within a state, the consumer affairs department has said in its advisory to state government­s. So, in addition to bottled water, no packaged items, including beverages, can be sold at two different MRPs in shops, multiplexe­s, or airports.
