COURT TURNS DOWN JAGAN’S BAIL PETITION

The Andhra Pradesh High Court on Monday dismissed the statutory bail applicatio­n of YSR Congress president Y.S. Jagan Mohan Reddy in the illegal investment­s case on technical grounds.

While dismissing the bail plea, Justice B. Seshasayan­a Reddy made it clear that since the petitioner was not in judicial custody under Section 167(2) of the Criminal Procedure Code (CrPC), the question of his availing statutory bail as provided under the proviso to Section 167(2) did not arise.

The judge added that the bail plea was dismissed on technical grounds and not on merits of the case.The court will hear the regular bail plea of Mr Jagan Mohan Reddy on Wednesday.

The judge refused to accept the contention that the CBI’s remand report was only in respect of the Vanpic case and not in other matters. “In my view, the arrest of the petitioner on May 27 was not only in Vanpic but also in respect of other matters,” said the judge.

While dismissing the bail plea of YSR Congress chief Y.S. Jagan Mohan Reddy on Monday, Justice B. Seshasayan­a Reddy said, “The CBI's remand report dated May 28 filed before the special CBI court is a comprehens­ive one. All the aspects that form the basis for registerin­g RC 19(A) have been stated therein. The CBI’s petition for extension of police custody revealed that extension has been sought for in respect of investigat­ion relating to various aspects mentioned in RC 19.”

The judge said that after filing the chargeshee­t in the Vanpic case, Section 167(2) of CrPC had become null and Section 309 was made applicable in the case.

He added there was no need to examine whether the SC had dealt with this point in the SLP.
