Delayed LIC claim dismissed

The AP State Consumer Disputes Redressal Commission has dismissed a complaint of a woman and her son following a delayed claim for the policy amounts from LIC for the death of her husband.

The district forum of Kadapa had initially directed LIC, to pay the policy amount along with vested bonus up to the date of maturity of the policy. LIC challenged this decision in the state forum.

The commission, after a hearing, dismissed the order passed by district forum. The commission ruled that a claim is maintainab­le if it is made within a period of two years from the date of cause of action; death in this case.

Shahzadi Begum and her son Mohammed Hafeezur Rehman were the two nominees of Mohammed Ghouse Peer, who had got his life insured with two policies from LIC. Ghouse died of a heart attack in 2000. They addressed a letter in 2009 requesting the insurance amount. The commission in its order said that such complaints can be filed after the expiry of the limitation period of two years only when it is supported by a petition to condone delay. However, in the current case, the complainan­t didn’t file any such petition and the case was dismissed.
