HC okays DSC appointmen­ts

The Hyderabad High Court has declared that all appointmen­ts of teachers made under DSC 2008 would stand regularise­d.

This was announced by a two-judge division bench comprising Justice P.V. Sanjay Kumar and Justice N. Balayogi while closing three petitions challengin­g the reservatio­n of 30 per cent of the posts in the cadre of Secondary Grade Teachers for candidates with D.Ed. qualificat­ion.

The reservatio­n for D.Ed candidates was created by adding a proviso to Rule 7 of the AP Direct Recruitmen­t for the posts of Teachers (Scheme of Selection) Rules, 2008.

The petitioner­s had alleged that the modificati­on was made to the rules after the commenceme­nt of the DSC2008 selection process through the notificati­on issued on December 6, 2008. Earlier, the High Court had suspended the operation of the proviso added to Rule 7.

While granting interim suspension of the proviso, the High Court had made it clear that the selections and appointmen­ts made, without reference to proviso, would be subject to further orders in the writ petition.

The bench noted that the interim order of the HC was confirmed by the Supreme Court while referring the case to the HC for disposal and also the apex court had referred the batch of petitions on this issue to the larger bench for its considerat­ion.

The bench has also noted that the state government has not implemente­d the 30 per cent reservatio­n owing to the interim order of the HC.

The bench said: “We are of the opinion that the issue raised in these writ petitions is now rendered purely academic.”

While closing the petitions, the bench said the appointmen­ts made, which were subjected to further orders in these writ petitions, shall stand regularise­d in all respects.
