HC okays DSC appointments

The Hyderabad High Court has declared that all appointments of teachers made under DSC 2008 would stand regularised.

This was announced by a two-judge division bench comprising Justice P.V. Sanjay Kumar and Justice N. Balayogi while closing three petitions challenging the reservation of 30 per cent of the posts in the cadre of Secondary Grade Teachers for candidates with D.Ed. qualification.

The reservation for D.Ed candidates was created by adding a proviso to Rule 7 of the AP Direct Recruitment for the posts of Teachers (Scheme of Selection) Rules, 2008.

The petitioners had alleged that the modification was made to the rules after the commencement of the DSC2008 selection process through the notification issued on December 6, 2008. Earlier, the High Court had suspended the operation of the proviso added to Rule 7.

While granting interim suspension of the proviso, the High Court had made it clear that the selections and appointments made, without reference to proviso, would be subject to further orders in the writ petition.

The bench noted that the interim order of the HC was confirmed by the Supreme Court while referring the case to the HC for disposal and also the apex court had referred the batch of petitions on this issue to the larger bench for its consideration.

The bench has also noted that the state government has not implemented the 30 per cent reservation owing to the interim order of the HC.

The bench said: “We are of the opinion that the issue raised in these writ petitions is now rendered purely academic.”

While closing the petitions, the bench said the appointments made, which were subjected to further orders in these writ petitions, shall stand regularised in all respects.
