Babu Rao, secretary of Sagar Cricket Club of the city challenging an order of a single judge in staying the order of the Ombudsman disqualifying Sheshnarayan as secretary of HCA. The Ombudsman disqualified Sheshnarayan on account of his figuring as an accused in a criminal case and the police filing the charge sheet before the trial court. The Counsel appearing for the appellant submitted that the trial court has taken cognisance of the charge sheet against Seshanarayan and issued summons to him and in such circumstances he should not be allowed to continue as office bearer of the Cricket Association as per the recommendation of Justice RM Lodha Committee. The Counsel for Seshanarayan submitted that only charge sheet was filed against his client and no summons were issued neither were the charges framed against him and therefore the question of disqualification would not arise.
