Indiabulls failed to deliver flat as agreed
Indiabulls Real Estate & Wholesale Services Ltd has been ordered to pay Madiri Vijay Kumar, a resident of Rajahmundry, an amount of `19,90,00 that includes a refund, compensation for deficiency of service and costs, by the district consumer forum.
The complainant said that he and his wife paid `1 lakh as advance for a twobedroom flat of 1,456 sq. ft in India Bulls Centrum Apartment at Lower Tank Bund at the rate of `3,600 per sq. ft for their son. Later when his wife visited the site, she was not happy with the flat and requested the sales manager for a three-bedroom flat. She was assured of the same and asked to transfer `17,85,000 which was done on June 24, 2015. Later the couple found the flat was seized by GHMC. The complainant, Mr Kumar, said though he paid more than 20 per cent of total sale amount, the defendant failed to enter into a deal.
The defendant said the complainant’s son chose to book a two-bedroom flat by paying `20,000.
While the total payment to be made was `22,37,999, only `18,85,000 was paid. Even when they intimated that the flat was ready for occupation the complainant’s son did not pay the balance. The defendant also denied that Block ‘B’ of the project had any issues with GHMC.
The forum said as per records it was evident the complainant had paid a substantial sum. It said the words ‘Provisional’ and ‘Tentative’ in the deal state the flat can be changed if required. The defendant has been directed to give a three-bedroom flat to the complainant or refund `18,85,000, with `1 lakh compensation and ` 5,000 towards costs.
