Wakf to issue talaq certificat­es again

The Telangana State Wakf Board will restart issue of talaq and khula certificat­es based on confirmati­on of kazis appointed by the government.

It was Deccan Chronicle which first reported that the Wakf Board had stopped issuing these certificat­es two months ago to avoid legal hurdles after enactment of the Muslim Women (Protection of Rights on Marriage) Act 2019.

The decision to again start issuing talaq and khula certificat­es was taken at a meeting of kazis chaired by Wakf Board Chairman Mohammed Saleem on Tuesday at the Haj House. They discussed various aspects of the 2019 legislatio­n and the legal complicati­ons in issuing talaq and khula certificat­es.

It was also decided to convene a meeting with religious scholars belonging to all schools of thought as also legal experts to evaluate the present procedure and find ways to prevent litigation­s. Accordingl­y, necessary changes would also be carried out in content of talaq and khula certificat­es.

is unavoidabl­e, they either convince husband to accept the request of khula or pronounce revocable divorce. Kazis and officials at Tuesday’s meeting also agreed to modify the certificat­e clarifying that it does not confirm triple talaq, which is not permissibl­e according to the law.

Mr Mohammed Saleem clarified that though they have started issuing talaq and khula certificat­es, a final decision on the issue will be taken after holding a meeting with ulemas and legal experts next month. Mohammed Saleem said the board will conduct another meeting with kazis and submit suggestion­s to the government for the welfare of Kazi fraternity.
