KDCA elections are put on hold
Justice G. Krishnamohan Reddy, Ombudsman of the Andhra Cricket Association, has stayed elections to the Krishna District Cricket Association scheduled on Sunday.
KDCA, an affiliate of the ACA, has been asked to adopt a new constitution in tune with the Supreme Court appointed Lodha Committee reforms.
“It is contended by the complainant in his written arguments that the President of KDCA without compliance of the order of the Ombudsman and without any fundamental constitution and just basing on the Rule No.
6 of the byelaws of ACA, cannot proceed with the election of its office bearers and shall wait for a subcommittee report on codifying the Lodha committee reforms for implementation to KDCA otherwise conducting the election on
06-12-2020 is invalid,” Justice Reddy said in his order dated December 5.
“It is held that the election process initiated by KDCA through the said election officer and also consequent unanimous election of the office bearers of its Apex council are declared as null and void and hence, cannot be enforced.
Further, ACA is hereby directed to form a committee to draft appropriate byelaws and, rules and regulations for KDCA in terms of its own byelaws and, rules and regulations subject to making necessary changes as early as possible because further delay in the matter causes more and more inconvenience to KDCA to elect its office bearers. In view of the inconvenience faced by KDCA because of non-conducting of its election after the expiry of the term of the previous office bearers, it is also observed that ACA has to take necessary measures to decide within one week as to who would form the full members of KDCA taking all aspects into consideration to enable KDCA to adopt temporarily the byelaws and, rules and regulations of ACA and then on that basis to conduct the election to its office bearers,” the order read.
