Woman alleges fake divorce against her

AFSHAN HAS alleged that Shiraz Khan, of Shiraz Foundation, has misused her signed paper in collusion with Ifthekar (husband) to create a self-declaratio­n document seeking Khula (divorce).

A woman, Afshan Fatima, resident of Band Lines in Basheerbag­h, has lodged a complaint with the police stating that a khula (divorce offer by the wife in Islam) had been fraudulent­ly issued in her name to make it appear that she had divorced her husband Syed Iftekhar, a plumber from Pensionpur­a, Langer Houz.

Afshan said she had married Iftekhar in December 2019. Due to harassment by her husband and in-laws, she approached Shiraz Khan of Shiraz Foundation for help on September 2, 2020. Shiraz reportedly collected `15,000 from her and asked her to pay another `35,000 for initiating legal proceeding­s.

Afshan said Shiraz also collected her and her mother’s signatures on a blank paper, apart from a proforma, for enabling divorce. As she could not arrange the extra amount, Afshan said she approached the women’s police station CCS on September 9, 2020, who registered a case of dowry harassment.

Afshan recounted that when police called her husband Iftekhar on December 22, 2020, the husband handed over to the police a copy of the Khula certificat­e issued by Qazzath Qillah Mohammed Nagar on November 11, 2020. The certificat­e stated that Iftekhar has accepted and approved the Khula offer from Afshan Fatima on September 5, 2020, and has given talaq-bayin (irrevocabl­e divorce).

Afshan has alleged that Shiraz Khan has misused her signed paper in collusion with Ifthekar to create a self-declaratio­n document seeking Khula. Following this, Afshan lodged another complaint against Iftekhar, Shiraz Amina Mohd Younus (witness) and Syed Rasheed (qazi) with the Humayunnag­ar police station on January 18, 2021. Afshan said no action has been taken so far.

Chief qazi of Qilla Mohammed Nagar Mohammed Yousufuddi­n Hussain said they never issue Khula certificat­e unless both parties appear before them. The qazi said he was ready to furnish all documents on the particular issue. The husband did not respond when this correspond­ent tried to contact him on phone.
