HC boost for physical edu. PG applicants

A two-judge bench of the Telangana High Court on Monday directed the Telangana State Public Service Commission (TSPSC) and other authoritie­s to accept applicatio­ns of candidates with postgradua­tion of physical education for the ongoing recruitmen­t to the posts of physical directors in junior colleges. The bench comprising Chief Justice Ujjal Bhuyan and Justice N. Tukaramji were dealing with a writ petition filed by one Ram Naresh and 191 others and two other writ petitions stating that the TSPSC notificati­on issued on December 28 was arbitrary and without the authority of law. Senior counsel point out that the prescripti­on of two post graduate degrees in physical education and another in any science, arts or commerce is discrimina­tory and hostile to the petitioner­s and was without jurisdicti­on. Since the last date for receipt of applicatio­ns was January 23, the bench directed that applicatio­ns may be received over the next seven days. The bench also made clear that if there were any technical glitches in submission of applicatio­ns, the commission should entertain physical handing over of the applicatio­n.

HIGH COURT FREES PD ACT DETAINEE

A two-judge bench of the Telangana High Court on Monday ordered notice to authoritie­s in a writ petition questionin­g whether a person charged of any economic offence could be detained under the Preventive Detention Act. The bench, comprising Justice Abhinand Kumar Shavili and Justice Pulla Karthik, was dealing with a habeas corpus petition filed by Karan Kumar seeking the release of his brother Mukesh Kumar. The petitioner pointed out that a person accused of economic offences cannot be a matter of public order', justifying such detention. It was also contended that preventive detention cannot be enforced in perpetuity while trial is pending. The petitioner pointed out that the ground cited was that the detainee had not violated or flouted conditions of the granted bail. The bench ordered the detainee to be freed.

HC QUASHES FIR BY MIN.'S PS AGAINST SCRIBE

Justice K. Surender of the Telangana High Court on Monday quashed an FIR filed against a journalist by transport minister's personal secretary Sadineni Kiran Kumar. The contention of the de facto complainan­t was that the journalist had defamed the minister live on television and had to be punished for the offence. Kiran Kumar complained that if he was left free there were chances he may commit the same mistake in the future as there were around 30 cases pending in his name of similar nature. On the other hand, counsel for the petitioner contended that all the cases pending were malicious and false. The court while hearing the arguments observed that the personal secretary of the minister cannot file any complaint on his behalf.
