More­over, on a care­ful read­ing of the Oc­to­ber 30-or­der passed by the Spe­cial Judge, it is ad­mit­ted that the FEO Act does not con­tem­plate the Court hear­ing the case to stay its own pro­ceed­ing. This fact was not con­sid­ered by the Bom­bay High Court, Na­ri­man said. He fur­ther sub­mit­ted that the FEO Act does not al­low Mallya to set­tle with the banks pend­ing trial, as once the as­sets are at­tached un­der the new law, the rights to them vest with the Cen­tre. This will hap­pen as soon as the Spe­cial Court passes or­ders declar­ing Vi­jay Mallya a fugi­tive. Thus re­fusal of stay will have se­ri­ous and ad­verse con­se­quences to the pe­ti­tioner, Na­ri­man ar­gued.

The Bench com­pris­ing the CJI and Jus­tice SK Kaul is­sued a no­tice to the En­force­ment Direc­torate seek­ing a re­sponse, but re­fused to stay the FEO Act pro­ceed­ings.
