Judgment in another case today

NEW DELHI: A Delhi court is scheduled to pronounce its judgment on Tuesday in a 1984 riots case in which Sajjan Kumar and five others are the accused. District judge JR Aryan had reserved the judgment on April 16 after the counsel for the CBI and the accused concluded their final arguments in the case.

If convicted under Section 302 (murder) of the Indian Penal Code (IPC), all accused would have to face minimum sentence of life imprisonme­nt; the maximum would be death penalty.

Kumar is facing trial along with Balwan Khokkar, Kishan Khokkar, Mahender Yadav, Girdhari Lal and Captain Bhagmal for allegedly conspiring and inciting a mob against the Sikh community in the Delhi Cantonment area here.

The case deals with the death of five members of a Sikh family — Kehar Singh, Gurpreet Singh, Raghuvende­r Singh, Narender Pal Singh and Kuldeep Singh. Kehar and Gurpreet were the husband and son, respec- tively, of complainan­t and eyewitness Jagdish Kaur. Raghuvende­r, Narender and Kuldeep were her brothers.

The case against Kumar was registered in 2005 on the recommenda­tion of justice GT Nanavati Commission. The CBI had filed two chargeshee­ts against him and the other accused in January 2010.

The trial court had in May 2010 framed charges against Kumar and the others under sections 302, 395, 427, 153-A, 120-B and other provisions of the IPC.
