QUOTA IN PROMOTION HC tells GNDU not to revert 3 general category staffers to previous posts
CHANDIGARH: The Punjab and Haryana high court on Wednesday told the Guru Nanak Dev University not to revert three general category employees to their previous posts.
The direction by the bench of justice Rajesh Bindal and justice Amit Rawal came on a petition challenging ‘The Punjab Scheduled Castes and Backward Classes (Reservation in Services) Amendment Act-2018’ which provides for reservation in promotion to SC/ST employees.
GIVEN INTERIM PROTECTION
“The court has given interim protection to these employees against reverting them to their previous posts,” said petitioners’ counsel Dharmender Singh Rawat.
The notice to government has been issued for January 17, he added.
The law came into force with effect from February 20, 2018.
The petitioners have argued that as per quantifiable data collected by the state for checking the representation of SC employees, they are adequately represented in the state.
The state has not relied upon any fresh data, the court was told. They had challenged a July 2018 decision of varsity syndicate, which decided to review all the promotions of general category employees.
There are 3.79 lakh employees in the state, of which, 1.1 lakh belong to the SC category.
