Fo­rum tells real es­tate firm to cough up R50,000

CHANDIGARH: District Con­sumer Dis­putes Re­dres­sal Fo­rum has pe­nalised Unitech Lim­ited and or­dered it to pay Rs 50,000 com­pen­sa­tion to a res­i­dent of In­dus­trial Area, Phase 1, Chandigarh.

Ac­cord­ing to the com­plainant, Anand Engi­neers booked a flat with op­po­site party no.1 un­der its prelaunch scheme, through JD Real­tors, and paid an ini­tial sum of Rs 6,50,000 by cheque. The scheme was fi­nally launched by op­po­site party in July 2007 and al­lot­ment let­ter was is­sued on July 31, 2007.

The de­tails in the al­lot­ment let­ter re­vealed that the ac­tual area and de­sign of the apart­ment was not as per the rep­re­sen­ta­tion made ear­lier. Ear­lier, it was pro­jected that the ap­prox­i­mate area of the apart­ment would be be­tween 1,400 and 1,900 square feet. But the pro­posed al­lot­ment was for 2,096 square feet that over­shot the bud­get by over Rs 6 lakh. The com­plainant did not ac­cept the al­lot­ment let­ter and sought re­fund of their ap­pli­ca­tion money. How­ever, the op­po­site party failed to re­fund the amount de­spite vis­its to their site at Noida.

The op­po­site party in their re­ply stated that no com­mu­ni­ca­tion re­gard­ing re­fund was re­ceived from the com­plainants. They pleaded that the com­plainant failed to make the pay­ment de­spite ask­ing them through var­i­ous let­ters. The op­po­site party de­nied any re­ceipt of le­gal no­tice. The fo­rum, af­ter see­ing the ev­i­dence pro­vided by both the par­ties, or­dered Unitech Lim­ited to pay Rs 50,000 as com­pen­sa­tion to the com­plainant.
